چکیده
جرائم اقتصادی از معدود جرائمی است که علیرغم سنتی بودن برخی از مصادیق آن ، مورد توجه حقوقدانان در دهه های اخیر قرار گرفته است . زیرا هر چه انسان به اقتصاد وابسته تر و نیاز انسان به اقتصاد شدیدتر می گردد ، آماده کردن بستر جامعه برای فعالیت های اقتصادی سالم و جلوگیری از مفاسدی که این فعالیت ها را به مخاطره می اندازد بیشتر احساس می شود .شناسایی این مفاسد و جرم انگاری در خصوص آن از دغدغه های قوه مقننه کشورهاست .در حیطه فعالیتهای اقتصادی آنچه باعث می شود یک عمل مفسده انگیز تلقی شود ، مضر بودن آن عمل و وارد کردن ضرر به جامعه و افراد جامعه است . لذا واژه ضرر همیشه با جرائم اقتصادی همراه بوده و بدون ضرر جرمی تحت عنوان جرائم اقتصادی محقق نمی شود . به عبارت دیگر از اجزای اساسی تشکیل دهنده عنصر مادی این جرائم ، ضرر است .

مقدمه
مال, (قوام) زندگی است واگردرست ازآن استفاده شود ، منشأخیرو سعادت برای انسان می گردد واگرناصحیح و نامشروع به کار گرفته شود, موجب هلاکت ونابودی خواهدبود.ازاین روی , استفاده های نارواوتصرفات ظالمانه وغاصبانه دراموال وازبین بردن حقوق دیگران, معاملات غرری,رشوه رباودریک کلام (اکل مال به باطل)[1] به معنای عام ووسیع آن , سبب هلاکت ونابودی مردم وازهم گسستگی جامعه اسلامی است.
جامعه ای که افراد آن , به راحتی حقوق یکدیگررا زیرپامی گذارندوآزمندانه دراموال دیگران تعدّی میکنند و درپی کسب درآمد افزونتر هستند بی هیچ پروایی درحرام وحلال آن تیشه به ریشه زندگی سالم و حق حیات می زنند. درحقیقت, هم خودرا به نابودی می کشند وهم دیگران را. همان کشتی راسوراخ می کنند که خود برآن سوارند.
«وَ لا تَأْکُلُوا امْوالَکُمْ بَیْنَکُمْ بِالْباطِلِ» (بقره، 188) «اموال همدیگر را به باطل (و ناحق) مخورید»
چارچوب نظری تحقیق
جرایم اقتصادی در اصطلاح عبارتند از: جرایمی که علیه اقتصاد کشور ارتکاب می یابند یا به این قصد انجام می شوند یا در عمل موجب اختلال در نظام اقتصادی کشور می شوند . جرم اقتصادی جرمی نیست که ویژگی اقتصادی داشته باشد ، بلکه جرمی است که آثار و تبعات سوء اقتصادی داشته باشد . اقتصاد در زندگی افراد جامعه ، نقش بی بدیلی را ایفا می کند و به دلیل برخورد مستقیم با زندگی مردم ، اساسی بوده و به هیچ عنوان نمی توان آن را نادیده گرفت ؛ به نحوی که به نقل از معصومین ، نابسامانی در حوزه اقتصاد نه تنها باعث اخلال در حوزه های دیگر زندگی می شود بلکه دین و معاد انسان را نیز تحت تاثیر خود قرار می دهد . فساد اقتصادی به متمرکز کردن ثروتها گرایش دارد و نه فقط شکاف میان غنی و فقیر را افزایش می دهد که برای مرفهان ، ابزارهای نامشروع حفاظت از موقعیت و منافعشان را تامین می کند . فساد اقتصادی شرایطی را فراهم می نماید که در سایه آن ، دیگر انواع جرایم تسهیل می یابند . بدون شک برقراری و حفظ نظم اقتصادی در گرو مبارزه با اخلالگران در نظام اقتصادی و مجرمین اقتصادی است . مبارزه با جرایم اقتصادی هم موجب برقراری نظم اقتصادی می شود و هم از آثار و تبعات مضر اختلال در اقتصاد کشور جلوگیری می کند.
اقتصاد و امور مادی همیشه در زندگی بشر ، حتی زمانی که به زندگی اجتماعی روی نیاورده بود ، رکن اساسی محسوب می شده است ، لیکن امروزه با پیچیده شدن زندگی اجتماعی و خارج شدن جوامع از مراحل ابتدایی و برقراری روابط گسترده انسانها ، اقتصاد جهش خیره کننده ای داشته و جلوه گری خاصی در جوامع پیدا کرده است . به میزان رشد اقتصاد و گسترش و پیچیدگی روابط انسانها ، جرائم اقتصادی هم با افزایش فزاینده ای روبرو و هم عملیات اجرایی آن از یک نوع پیچیدگی برخوردار می باشد ، لذا واکنش با آن باید با اتخاذ تدابیر لازم و اعمال سیاست جنایی شایسته توام گردد . اشکال مختلف و جدید اقداماتی که موجبات فساد اقتصادی را در جامعه فراهم می کند و مردم را از نظر اقتصادی در تنگنا قرار داده و برخی از این اعمال ، امنیت اجتماعی را مخاطره می اندازد قانونگذاران کشورهای جهان را به حرکت سریع در جهت جرم انگاری نسبت به این اعمال سوق داده و آنان را وادار به تصویب مقرراتی که مانع وقوع این اعمال شود مینماید .[2]
در جامعه ما ایران مسئله مبارزه با مفاسد اقتصادی در سالهای اخیر مطرح است ، دولتمردان دستگاههای قضائی روزنامه ها و دیگر وسایل ارتباط جمعی مطالب زیادی در خصوص این مفاسد مطرح می کنند . صدها ها پرونده در محاکم سراسر کشور در این باره به جریان افتاده است . اکثر مردم و حتی اندیشمندان معضلات موجود در امور اقتصادی و فرهنگی و سیاسی جامعه را ناشی از وجود این مفاسد می دانند . گذشته از این ، ایده تاثیر ناامنی اقتصادی در سلب اعتماد مردم از دولتمردان به دلیل وجود این مفاسد مطرح است . بنابراین واکنش در مقابل آن هم مانع خدشه دار شدن امنیت اقتصادی می گردد ، و هم اعتماد مردم به دولتمردان را تامین خواهد کرد . [3]البته باید توجه داشت برای مبارزه با این مفاسد آنچه در حیطه کار حقوق جزاء می گنجد و به دستگاههای قضائی کشور و قوه قضائیه مربوط است . مبارزه با مفاسدی است که در قالب یکی از جرائم قانونی صورت گیرد . به بیان دیگر مفاسد اقتصادی دایره وسیعتر و گسترده تر از جرایم اقتصادی دارد . چه اینکه معناء و مفهوم «فساد» با « جرم » متفاوت است . اصولاً تا نسبت به حرکت فساد انگیز و عمل مضربه حال افراد و جامعه توسط قانونگذار جرم انگاری نشده باشد ، آن عمل جرم تلقی نخواهد شد . هر چند امکان دارد ضرر ناشی از آن از بسیاری از اعمال مجرمانه دیگر بیشتر باشد .[4]

1-مقدمه


در قانون اجرا احکام مدنی در زمان توقیف اموال، حفظ اموال در مواردی که نگهداری آن در محل توقیف امکان‌پذیر باشد با تعیین حافظ در همان محل حفظ می‌شود حافظ اموال بایستی با توافق طرفین تعیین گردد که مسئولیت نگهداری اموال را دارد در این میان هم مواردی در قانون بیان شده که مسئولیت حفظ اموال به شخص ثالث داده می شود .حافظ در لغت نعت فاعلی از حفظ. نگاهدارنده . نگاهدار. نگهدار. نگهبان (عمید،1357)ودر تعاریف حقوقی یعنی این که شخص امینی که در اجرا احکام یا اسناد مال توقیف شده به دست او امانت سپرده می شود.(جعفری لنگرودی،1387) اگر کسی در مال دیگری تصرف مشاع و مجاز کند ید ا و نسبت به آن امانی است و مسئول جبران خسارت وارده نیست مگر اینکه مالک تعدی و تفریط او را اثبات نماید. تصرف مجاز ممکن است از اذن صریح و ابتدایی شارع ناشی شود که به امانت شرعی معروف است و یا اذن ضمنی شارع در تنفیذ اذن و معاملات نالک ناشی شود که به امانت مالکی مشهور است.اگر شرط ضمانت حافظ باشد مفهوم این است که باید در نگهداری و حفاظت از مال تلاش کند و خسارتی بر آن وارد شود، جبران کند و اگر شرط نتیجه شود اگر خسارتی بر مال وارد شود امین ضامن نخواهد بودو در فقه اسلامی درباره متصرف مشروع در نال غیر،امانی است و در صورتی مسئول است که تعدی و تفریط لاو ثابت گردد و در عرف جانعه در بسیاری از موارد ، مالک به مسئولیت امانی متصرف اکتفا نمی کند بلکه ضمن شرط ضمنی و عرفی یا شرط شخصی، بر مسئولیت و ضمان امین تصریح می‌کند و او را ضامن مال مورد تصرف قرار می دهد.

قانون آیین دادرسى مدنى درباره توقیف اموال، در ماده 126 مقرّر مى‏دارد: «توقیف اموال اعم از منقول و غیرمنقول و صورت‏بردارى و ارزیابى و حفظ اموال توقیف شده و توقیف حقوق استخدامى خوانده و اموال منقول وى که نزد شخص ثالث موجود است، به ترتیبى است که در قانون اجراى احکام مدنى پیش‏بینى شده است.» بنابراین، توقیف اموال، چه منقول و چه غیرمنقول، باید مطابق مقرّرات قانون اجراى احکام مدنى صورت بگیردتوقیف مصدر باب تفعیل و از ریشة «وقف» است و در لغت به معنی بازداشت و بازداشتن و به طور کلی، به معنای سلب آزادی از شخص یا مال او با حالت انتظار ترخیص است، که در صورت اول توقیف شخص و در صورت دوم توقیف مال صدق می‌کند. در اصطلاحات مختلف، «توقیف» به صورت مضاف با کلمه یا کلمات دیگر می‌آید. عمدتاً در همه جا همین معنای لغوی لحاظ می‌شود. مثلاً توقیف مال، توقیف اجرای حکم، توقیف اجرایی، توقیف احتیاطی، توقیف اشخاص، توقیف حقوق، توقیف دادرسی، توقیف سرقفلی، توقیف ضامن، توقیف عقود، توقیف مالم یجب، توقیف متعهد یا مدیون، توقیف عملیات ثبتی و توقیف عملیات اجرایی.به علاوه، آیین‏نامه اجراى مفاد اسناد رسمى لازم‏الاجراى جدید مصوب 11/6/1387 نیز مواردى را به توقیف اموال غیرمنقول اختصاص داده است. از این‏رو، براى روشن شدن حدود و جوانب موضوع، بررسى تطبیقى میان قانون اجراى احکام مدنى و آیین‏نامه جدید ضرورت دارد. مبحث پنجم و ششم قانون اجراى احکام مدنى، مسئولیت حافظ و شخص ثالث بیان شده است.

ABSTRACT

 

This study investigated teachers’ perceptions about the effects of Recast and Metalinguistic Feedback on Pronunciation of Elementary Learners. This study examined teachers’ preferences for pronunciation error correction and compared the differences between them, suggesting more effective ways of treating learners’ pronunciation errors in English Second Language settings. Recast and Metalinguistic Feedback are two important correction feedbacks which have great effects on language teaching and learning strategies. Therefore understanding learners` pronunciation mistakes and knowing teachers` perceptions have always been one of the highly controversial issues among language teaching experts. The purpose of this study was the preferences for pronunciation error correction among teachers. One hundred adult English Second Language teachers in seven branches of Javanan Bartar Institute participated in this survey. They were selected from adults with the same level of proficiency and all of them were teaching elementary learners. The results revealed that the teachers agreed that pronunciation error correction especially Recast is necessary for L2 improvement. In general there were more significant differences between the teachers regarding Recast than those teachers who considered Metalinguistic Feedback.

1.1. Introduction

One of the main areas of research in second language is the significance of pronunciation error correction and its subsequent effects on language learning. Looking at the teacher and learner interaction allows us to examine the type of language communication that is practiced within the classrooms. Although studies have been conducted on teacher’s feedback, limited research is known about teacher’s verbal or immediate feedback in the classroom. This study provides an awareness of the feedback practices employed in the classroom interaction and learner learning.

In the context of teaching and learning languages, various definitions of the term feedback have been proposed. Most of these definitions indicate that feedback refers to informing learners about their work in progress. More specifically, this form of interaction shows learners their errors and guides them to correct their work (Ur, 1996; Lewis, 2002). An important point that needs consideration concerns the purpose of providing feedbacks. According to Boud (2002), “A good feedback is given without personal judgment or opinion, given based on the facts, always neutral and objective, constructive and focus on the      future” (p.7).

Thus, the use of appropriate and qualified type feedback can be viewed as a significant tool in enhancing learner learning. Mastropieri and Scruggs (1994) expounded that feedbacks should be outcome-focused and encouraging. However, Lenz, Ellis and Scanlon (1996) suggested that not only should feedback focus on what learners did incorrectly, but also on matters to improve future accomplishments. Attending to these forms of feedback would facilitate teachers in identifying learners’ needs and more likely to see positive outcome from learners.

Among the studies about error correction, recast has proved to be the most frequent error correction. Recast is one type of interactional feedback that has received much attention in second language acquisition .It involves the teacher’s reformulation of all or part of a learner’s utterance, minus the error and it often takes the form of confirmation checks. Spada and Frohlich (1995; cited in Lyster and Randa 1997) also referred to such reformulations as “paraphrase”. Recasts are generally implicit in that they are not introduced by phrases such as “You mean,” “Use this word,” and “You should say”. However, some Recasts are more salient than others in that they may focus on one word only, whereas others incorporate the grammatical or lexical modifications into a sustained piece of discourse. Recasts also include translations in response to a learner’s use of the first language (Lyster and Randa, 1997).

A Recast is a technique used in language teaching to correct learners’ errors in such a way that is not obstructed. To Recast an error, a teacher will repeat the error back to the learner in a corrected form. Recasts are used both by teachers in formal educational settings, and by adults to improve children’s native language skills. A frequently used technique is for the adult to imitate the child’s speech. In this form of Recast, the adult repeats the child’s incorrect phrases incorrect form. This enables the child to learn the correct pronunciation, grammar and sentence structure. Recasts can be used for teaching second languages. In this form the Recast is usually more than a simple repeating of the learner’s words. The teacher will correct the learners’ errors but also extend the learning by additional words or phrases (such as asking a question). Recasts are provided only when learners failed to provide the correct form. Once provided, the learners are required to repeat the teachers’ reformulation.

Recasts draw learner’s attention to mismatches between input and output and cause them to focus on form. The learner  modifies  his utterance by repeating the feedback. However, Recasts are much less likely to lead to immediate self-correction by the learners, relatively speaking, than are other feedback types. Recasts are well suited to communicative classroom discourse, because they tend not to interrupt the flow of communication, keep learners’   attention focused on meaning, and provide scaffolds that enable learners to participate in interaction that requires linguistic abilities exceeding their current developmental level. Up to now there have been many studies of the role of Recast in second and foreign language acquisition.

In these studies the greater effectiveness of Recasts lies in situations where learners are given additional cues that help them recognize Recasts as feedback on pronunciation error.

Much like explicit error correction, Metalinguistic Feedback diverts the focus of conversation towards rules features of the target language. Metalinguistic Feedback contains either comments, information or questions related to the well-formedness of the learners’ utterance, without explicit providing the correct form. According to Lyster and Randa, 1997, Metalinguistic comments generally indicate that there is an error somewhere. Metalinguistic information generally provides either some grammatical Metalanguage that refers to the nature of the error (e.g., “It’s masculine”) or a word definition in the case of lexical errors. Metalinguistic questions also point to the nature of the error but attempt to elicit the information from the learners (e.g., “Is it feminine?”).

Abstract:

 

This study investigates whether multimedia had any effects on reading comprehension improvement among Iranian EFL learners at pre-intermediate level. To this end, the researcher administered a proficiency test (NELSON) to 105 learners from Shokouh institute at pre intermediate level and then according to their scores limited them to 70. The subjects were randomly divided into two homogenous groups. In fact, each group included 35 homogenous students, then as a pretest a reading comprehension test that was made from “tell me more” software was given to the control group and experimental group to see whether they were equal or different. To meet this purpose, during their sessions they read with multimedia text provided with comprehension aids (text, picture, and sounds). The other group received no multimedia training and served as a control group. Both groups received the same materials, and had instruction for thirty –minute periods for ten sessions. To be sure of the effect of the treatment, the researcher tested both groups by using a post-test. The result of pre and post test showed the second groups performed significantly better on the test than the control group. Finally, a T –test was conducted to examine the differences of the mean test score of the two groups. The results of the pre and posttest which served as the statistical basis for the two groups and a t-test comparisons of group means showed a t-value greater than the t- critical. Therefore, the null hypothesis was rejected and we came to this conclusion that multimedia had significant effects on learning reading comprehension among Iranian EFL learners at pre- intermediate level.
